Owner/Operator: My Recipe Critic (“we,” “us,” or “our”)

These Terms of Use (“Terms”) form a binding agreement between you and My Recipe Critic. By accessing or using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.

1) Who We Are & What We Provide

My Recipe Critic publishes home-cooking content: recipes, tips, photos, videos, and related editorial material intended for a general U.S. audience. Content is provided for informational and educational purposes only and is not professional advice (culinary, medical, nutritional, or otherwise).

2) Eligibility & Acceptable Use

You must be at least 13 years old to use the Site. If you create an account (now or in the future), you must provide accurate information, keep your credentials secure, and promptly notify us of any unauthorized use.

You agree not to:

• Break the law or infringe anyone’s rights.

• Post or transmit abusive, defamatory, hateful, harassing, pornographic, or otherwise objectionable content.

• Upload malware, spam, or conduct automated scanning/scraping that degrades performance.

• Copy, mirror, or frame significant portions of the Site without written permission.

• Use our content to train, fine-tune, or evaluate machine-learning or AI models without our prior written consent.

• Interfere with security features or attempt to access non-public systems.

We may suspend or terminate access for violations, suspected fraud, or harm to the Site or its users.

3) Intellectual Property & License to You

Unless otherwise indicated, all content on the Site—text, recipes, photos, videos, graphics, trademarks, logos, and code—is owned by or licensed to us and protected by U.S. and international laws.

Limited License. We grant you a personal, non-exclusive, non-transferable, revocable license to access and use the Site for non-commercial purposes. You may print or save individual recipes for personal use. Any other use (including republication, systematic download, distribution, derivative works, or commercial exploitation) requires our prior written permission.

No Rights Granted. Except for the limited license above, all rights are reserved. No license is granted by implication or estoppel.

4) User Submissions: Comments, Ratings, Recipes, Photos

If the Site allows comments, ratings, or user-generated content (“UGC”):

• Your responsibility. You are solely responsible for your UGC and warrant that you own or have the necessary rights to post it.

• License to us. By submitting UGC, you grant us a worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, display, and perform your UGC in any media for operating, improving, and promoting the Site and our services.

• Moderation. We may (but are not obligated to) review, edit, or remove UGC for any reason, including violations of these Terms or our community standards.

Do not submit confidential or proprietary material. We have no obligation to keep UGC confidential or to pay for it.

5) Food Safety, Health & Nutrition Disclaimers

Cooking involves inherent risks (e.g., cuts, burns, foodborne illness). You are responsible for safe food handling, verifying internal temperatures with a food thermometer, and complying with relevant food safety guidelines. Always check product labels for allergens. Ingredient availability and nutrition may vary by brand and region.

Not Medical or Nutritional Advice. Any nutrition data on the Site are estimates only and are not a substitute for professional advice. Consult a qualified professional regarding medical, dietary, or allergen concerns.

You use the Site and recipes at your own risk.

6) Editorial Independence, Advertising & Affiliate Links

We may fund the Site through display ads, sponsorships, and affiliate links. If you click an affiliate link and make a purchase, we may earn a commission at no extra cost to you. Sponsored content—if any—will be clearly labeled. Our editorial opinions are our own.

Third-party ads and links are provided for convenience. We do not control or endorse third-party sites and are not responsible for their content, policies, or practices.

7) Privacy

Your use of the Site is also governed by our Privacy Policy, which explains what data we collect and how we use it. By using the Site, you consent to our data practices as described there.

8) Accounts, Emails & Electronic Communications

If you subscribe to our emails, you consent to receive communications from us electronically. You may opt out of marketing emails at any time via the Unsubscribe link (we may still send non-marketing messages, e.g., service notices). You are responsible for keeping your email address current.

9) DMCA / Copyright Complaints

We respect intellectual property rights. If you believe content on the Site infringes your copyright, please submit a DMCA notice with the following:

2. Identification of the copyrighted work;

3. Identification of the material claimed to be infringing (URL) and information reasonably sufficient to permit us to locate it;

6. A statement, under penalty of perjury, that the information is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.

10) Prohibited Automated Access & TDM (Text/Data Mining)

Without our prior written consent, you may not use bots, spiders, scrapers, or similar tools to access, extract, download, or index Site content, nor may you perform text/data mining or use Site content to train or fine-tune AI or machine-learning systems. This prohibition applies regardless of robots.txt directives and is in addition to any rights under applicable law.

11) Promotions, Giveaways & Contests

If we run a promotion, it will be governed by official rules posted with the promotion, which will control in the event of any conflict with these Terms. Promotions are void where prohibited and subject to applicable laws.

12) Availability & Changes to the Site

We may update, suspend, or discontinue any part of the Site at any time without notice. We are not liable if all or any part of the Site is unavailable at any time. We also reserve the right to modify recipes, instructions, or features for clarity, accuracy, or safety.

13) Warranty Disclaimer

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

WE DO NOT WARRANT THAT THE SITE WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED, OR THAT DEFECTS WILL BE CORRECTED, OR THAT CONTENT WILL BE ACCURATE, RELIABLE, OR SUITABLE FOR YOUR PARTICULAR NEEDS. YOUR USE OF THE SITE IS AT YOUR OWN RISK.

14) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE OR OUR OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, OR AFFILIATES BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH

DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THE SITE SHALL NOT EXCEED $100 OR THE AMOUNT YOU PAID US (IF ANY) IN THE PAST 12 MONTHS FOR ACCESS TO THE SITE, WHICHEVER IS GREATER. SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS OF LIABILITY; SOME OF THE ABOVE MAY NOT APPLY TO YOU.

15) Indemnification

You agree to defend, indemnify, and hold harmless My Recipe Critic and our officers, directors, employees, contractors, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your use or misuse of the Site; (b) your UGC; (c) your violation of these Terms; or (d) your violation of any third-party rights or applicable

law.

16) Third-Party Services & Links

The Site may integrate with or link to third-party platforms (e.g., video embeds, social sharing, analytics, advertising). Those services are governed by their own terms and policies. We are not responsible for third-party acts or omissions.

17) Governing Law; Dispute Resolution

These Terms and your use of the Site are governed by the laws of the State of [Your State], USA, without regard to conflict-of-law principles.

Informal Resolution. Before filing a claim, you agree to try to resolve the dispute informally by emailing us at [l] with “Dispute” in the subject line and a brief description. If we cannot resolve it within 30 days, the dispute proceeds as below.

Arbitration; Class-Action Waiver (U.S. users). Except for small claims court or claims seeking injunctive relief, any dispute shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

You and we waive the right to a jury trial and to participate in a class action or class-wide arbitration. Each party brings claims only in its individual capacity.

20) Termination

We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including suspected violations of these Terms. Upon termination, your right to use the Site ceases immediately, but the following provisions survive: Intellectual Property, User Submissions, Warranty Disclaimer, Limitation of Liability, Indemnification, Governing Law; Dispute Resolution, and Termination.

21) Miscellaneous

• Entire Agreement. These Terms, together with our Privacy Policy and any posted guidelines or rules, form the entire agreement between you and us regarding the Site.

• Severability. If any provision is found unenforceable, the remaining provisions remain in full force.

• No Waiver. Our failure to enforce any right is not a waiver of that right.

• Assignment. You may not assign these Terms without our consent. We may assign them as part of a merger, acquisition, or sale of assets.

• Headings. Headings are for convenience only and do not affect interpretation.
